We earlier informed about the suspension of the functioning of IP Offices in India and the Courts in Delhi up till April 14, 2020. However, pursuant to the Prime Minister’s announcement dated April 14, 2020 for extension of lock down until May 3, 2020, the Office of the Controller General of Patents, Designs, Trademarks and Geographical Indication (CGPDTM) has issued notice dated April 15, 2020 making all IP Offices physically inaccessible to the people until May 3, 2020. As a result, all hearings scheduled up to May 3, 2020 before IP Offices now stand adjourned and fresh dates of hearing will be notified by the respective IP Offices.
According to CGPDTM notice, the extension provided under the previous Public Notices of CGPDTM with regard to the timelines to file any document or to take any action or pay fees under any IP laws shall also stand extended until May 3, 2020 or till the further order to be passed by the Supreme Court of India in the Suo Motu Writ Petition No. 3 of 2020.
The Administrative and General Supervision Committee of the Hon’ble High Court of Delhi has also issued order to suspend the functioning of the High Court and its subordinate courts in Delhi till May 3, 2020. The arrangements made by the Hon’ble Court for mentioning and hearing of urgent matters through videoconferencing, however shall continue as before. The Hon’ble Court has also decided to increase the number of Benches, hearing matters through videoconferencing.
However, hearings in all pending matters listed before the High Court (including the Courts of Registrars and Joint Registrars) which were scheduled from April 16, 2020 to May 2, 2020 has been adjourned to corresponding dates in the months of June and July, 2020 starting from June 16, 2020 to July 2, 2020.
