A recent judgment in Communication Components Antena Inc. vs. Rosenberger Hochfrequenztechnik Gmbh & Co. Kg. & Ors. by the High Court of Delhi garnered quite some attention from the legal fraternity, particularly, for the procedure laid down by the Court for a patent infringement trial. This matter is a patent infringement action for patent number IN240893, which is granted in favour of the plaintiff and is valid till March 17, 2027. During the pendency of the suit, the defendants also filed a counterclaim seeking revocation of the patent under Section 104 of the Patents Act, 1970.
